Sean Foy is a Senior Associate at Panetta McGrath specialising in Employment and Workplace Relations.
Vehicle Salespersons are commonly incentivised and paid to increase sales by way of commissions. Under these arrangements their total remuneration package can be extremely generous. However, vehicle salespersons are also subject to the Vehicle Repair, Services and Retail Award (the VRSR Award) which imposes obligations on how commissions are paid and also creates other legal entitlements. The interaction with the Award can often give rise to a number of important questions:
- What rights and obligations does the award create when a commission is agreed
- What award entitlements can be set off by commissions (such as retainers)?
- When drafting commission agreements what should dealerships be careful of?
- When vehicle salespersons go on leave is an average commission payable?
Sean will discuss these issues and provide practical advice on how to deal with commission related problems arising under the Award.

- Most common cases lodged with Consumer Protection against dealers and statistics
- The steps CP takes following a case lodgement (automated, engagement and advice)
- What steps can a dealer take if a customer’s claim is unreasonable, and still assist with the conciliation process
